STATUTE 9 The Council 1. T h e n om i n a t ed and electe d members of the Co u n c il shall h o ld office for three years f r om the date of their n om i n a t i on or election and shall be eligible fo r r e - n om i n a t i on or re-election p r o v i d ed that members elected u n d er the provisions of paragraphs ( f ) and (h) of section 11 of the Ordinance shall cease to be members of the Co u n c il if they cease to be members of the Board of Governors or of the Senate respectively w h i ch elected them, 2. Sh o u ld a n om i n a t ed or elected memb er of the Co u n c il die or resign d u r i ng his period of membership, the b o dy w h i ch n om i n a t ed or elected h i m shall d u ly nominate o r elect, as the case may be, a successor whose memb e r s h ip of the Co u n c il shall be for the u n e x p i r ed period of memb e r s h ip of his predecessor. 3. Memb e rs of the Co u n c il whose memb e r s h ip derives f r om the provisions of paragraphs (b), (c), (d), (e), and (g) of section 11 of the Ordinance shall r ema in members of the Co u n c il for so long as they h o ld the office or a p p o i n t me nt b y reason of w h i ch they became members of the Council. 4. T h e Co u n c il shall elect f r om among its members a V i c e - Ch a i r man w h o shall h o ld office for a period of t wo years. A r e t i r i ng V i c e - Ch a i r man may be re-elected. 5. Subject to the provisions of the Ordinance and the Statutes and w i t h o ut derogating f r om the generality of its power, it is specifically prescribed— (1) that the Co u n c il shall have the p o w e r— (a) to make Statutes, p r o v i d ed that no Statute shall be made u n t i l the Senate of the Un i v e r s i ty and the Board of Governors of each College shall have had an o p p o r t u n i ty of r e p o r t i ng thereon to the Co u n c il ; (h) to make decrees for any purpose for w h i ch decrees are or may be authorized t o be made, p r o v i d ed that no decree shall be made u n t il the Senate of the Un i v e r s i ty and the Board of Governors of each College shall have had an o p p o r t u n i t y of r e p o r t i ng thereon to the Council ; (c) to invest any mo n ey belonging to th e Un i v e r s i ty ; ( d ) to b o r r ow mo n ey on behalf of the Un i v e r s i ty ; (e) to sell, b u y, exchange, lease or accept leases of any real or personal p r o p e r ty on behalf o f the Un i v e r s i ty ; ( f ) to enter into, vary, p e r f o rm and cancel contracts on behalf of the Un i v e r s i t y; (g) to require the Board of Governors of each College annually to s u bm it i n such f o r m and at such time as the Co u n c il may determine estimates of the expenditure necessary to carry out the w o rk of that College ; ( h ) to require the Board of Governors of each College annually t o produce its audited accounts i n such f o r m and at such t i me as the Co u n c il may determine ; (i) to receive f r om p u b l ic sources grants for capital and re-current expenditure ; ( j ) to receive gifts ; ( k ) to make grants to the Board s of Governors of the severa l Colleges for capital and re-current expenditure; ( I ) to provide for the welfare of persons employed by the Un i v e r s i ty as distinct f r om the Colleges and the wives, w i d ows and dependants of such persons, i n c l u d i ng th e payment of money, pensions, or other payments an d to subscribe to benevolent an d other f u n ds for the benefit of such persons ; (m) to provide for th e discipline and welfare of students; (n) to r e c omme nd the conferment of degrees honoris causa; (o) after report f r om the Senate to establish additional Faculties or to abolish, combine or subdivide any Faculty ; ( p ) w i th the consent of the Senate and the Board of Governors of the College i n w h i ch the a p p o i n t me nt is tenable to abolish or h o ld i n abeyance any professorship, readership or senior lectureship; 11
